Resident Bill of Rights
- Every Resident has the right to be treated with courtesy and respect in a way that fully recognizes the resident’s dignity and individuality and to be free from abuse of any kind.
- Every Resident has the right to proper shelter, food, clothing, and to make personal choices which are consistent with their health care needs. Residents are to be given the opportunity to select the clothing they wish to wear each day.
- Every Resident has the right to live in a safe, clean environment.
- Every Resident has the right to access protected areas outside the Home in order to enjoy outdoor activity, unless conditions makes this impossible.
- Every Resident has the right to keep in their room personal possessions, pictures and furnishings in keeping with safety, security and space requirements and co-residents’ care needs and rights.
- Every Resident has the right to be told who is providing the resident’s direct care and who is responsible.
- Every Resident has the right to be afforded privacy in treatment and personal care.
- Every Resident has the right to be informed of their medical condition, treatment and proposed course of treatment with authorization from the appropriate physician; to give or refuse consent to available treatment, including medication, in accordance with the law and to be informed of the consequences of giving or refusing consent; to have the opportunity to participate fully in making any decision and obtaining an independent medical opinion concerning any aspect of their care including any decision concerning their admission, discharge or transfer to or from a personal care home; to have their medical records kept confidential in accordance with the law; and to have an Advanced Health Care Directive in accordance with Manitoba Legislation.
- Every Resident who is being considered for restraints has the right to be fully informed about the procedure and the consequences of receiving or refusing them.
- Every Resident whose death is likely to be imminent has the right to have family members/advocates present twenty-four hours per day.
- Every Resident has the right to name another person to have access and be informed regarding their personal health information such as medical records, hospitalization, care needs, etc., on their behalf, in accordance with The Personal Health Information Act (PHIA) &/or Advanced Health Care Directive Act &/or Enduring Power of Attorney.
- Every Resident has the right to receive therapy and assistance towards independence consistent with their requirements.
- Every Resident has a right to choose & participate in social, cultural, religious and other activities or interests and be given access to those resources as available through the home to meet those needs.
- Every Resident has the right to exercise the rights of a citizen and to raise concerns or recommend changes in policies, and services on behalf of themselves or others to the Resident and Family Advisory Council, Home Staff, Government Officials or any other person inside or outside the Home, without fear of restraint, interference, coercion, discrimination or reprisal.
- Every Resident has the right to participate in the Resident and Family Advisory Council.
- Every Resident has the right to meet with their spouse in a room, where available, that assures privacy. If appropriate shared accommodation is available, spouses will be given the opportunity to live together if desired.
- Every Resident has a right to communicate in confidence, to receive visitors of choice, and to meet in private.
- Every Resident has the right to manage their own financial affairs where able to do so. Where the resident’s financial affairs are managed by the Home they are to receive a regular accounting of transactions undertaken and to be assured that their property is managed solely on their behalf.
- Every Resident has the right to be informed in writing of any law, rule or policy affecting the operation of the Home and the procedures for initiating complaints.
- Every Resident has the right to be represented by an advocate designated by the resident (Power of Attorney &/or Proxy) or appointed by the Province of Manitoba (Public Trustee or Committee), in the event that health conditions preclude personal representation.
